This site is published by MAYURI, a Société par Actions Simplifiée (simplified joint stock company) with capital of €30,000, whose registered office is located at 229 rue Saint-Honoré, 75001 PARIS (France), registered with the Paris Trade and Companies Registry under SIRET number 853 309 912 00022.

 and VAT number FR32853309912.

The general conditions of sale set out below define the rights and obligations of the company MAYURI as well as of the purchaser, hereafter called "Customer".

All orders imply prior consultation and acceptance of the general terms and conditions of sale by the customer.

The general terms and conditions of sale are accessible at any time on our website and can be downloaded by clicking here.

Given the seasonality of our business, our product offers are valid within the limits of available stocks.

The mayuri.fr website reserves the right to change these conditions at any time without notice.

Any changes will be mentioned in these general terms and conditions of sale.

  

CUSTOMERS

 

Only natural persons who are not traders acting within the framework of their personal needs are considered customers.

The customer declares that he has the legal capacity to conclude this contract, i.e. that he is of legal age and that he is not under legal or conventional protection, according to article 1146 of the Civil Code. 

Clients must be at least 18 years of age, or the age of majority depending on the country.

For minors, express written permission from their parents is required. 

The Customer of the site must be a consumer, a natural person of full age and legally capable.

The Customer is held responsible for the accuracy of the information concerning him/her, in particular his/her contact details so that his/her order can be delivered to him/her.

The Customer must clearly identify himself by creating a personal customer account where he will have to fill in his identity: his name, first name, address and e-mail address which are his own.

Any legal entity wishing to purchase products from the website must first send a written request to the following address: [email protected].

 

PRODUCTS

 

  • In case of unavailability of the product, you can register by adding your email address to be notified as soon as the product has been restocked.
  • Our jewellery is unique and handcrafted, sometimes including natural stones. Therefore, minor variations may exist between the photographs presented on the website and the jewelry received. 
  • For rings, when a size is required, please refer to the ring gauge downloadable from the website. Customers can also contact customer service for further information at [email protected].
  • Each product has a detailed product sheet showing its main characteristics.

The weight of metal (silver, gold, platinum) indicated is valid for the average size of the reference in question.

 

PRIZE

  • The prices indicated on the site are expressed by default in euros all taxes included (TTC), excluding transport costs which are defined in the article "DELIVERY".
  • The VAT included is the French VAT in force on the day of the order. 
  • The products remain the property of MAYURI until the complete payment of the price.
  • Modification of prices: MAYURI reserves the right to modify its prices at any time and without notice.

The products already ordered will remain invoiced on the basis of the rates in force at the time of registration of your order.

 

ORDERS

Ordering process : 

You can place an order on our site according to the following process:

  • Consultation of products and their specificities
  • Add to cart
  • Adding your information
  • Payment

Only after confirmation of the accuracy of the information provided will the order be registered.

We will acknowledge receipt of your order by email, to the email address provided by you when confirming your order.

If, independently of our will, the chosen item is not available, you will be notified as soon as possible.

You will then be able to modify your choice if you wish or cancel your order.

MAYURI reserves the right not to honour an order in the event of legitimate reason as defined by the regulations (litigation relating to a previous order, abnormal request of the customer).

Orders will be shipped the same day, if the date of registration of your order is before 10:00 am. Beyond that time, the shipment will be made the next day.

 

PAYMENTS

Your order is recorded for preparation at the moment the payment transaction is validated whatever the chosen method of payment.

  1.  By credit card via Shopify Payment: your order will be debited within 7 days. The order registration date is the date of online payment. Credit card transactions are secured by the system.
  2. By PayPal: the amount of your order is debited immediately. The order registration date is the date of online payment.
  3. By Apple Pay: the amount of your order is then debited at the same time. The date of registration of the order is the date of the online payment.
  4. By Alma: you pay in 3 instalments, these amounts will be debited by Alma on the dates announced at the time of your order. In case of return for reimbursement, your first instalment will be reimbursed by Alma and the other instalments will be automatically cancelled.
  5. BitPay: for payment in cryptocurrency.The amount of your order is then debited at the same time. The order registration date is the date of online payment. Refunds are made at the discounted fiat value, the amount taken into account always being the price of the product in EUR.
  6. Bank transfer: your order will only be validated when the Mayuri team receives the full amount of your order on our bank account. Bank transfers are made directly by the customer via their own banking interface. A message confirming receipt of the funds is sent to the customer upon confirmation by the team.

  

INVOICING

 

At the customer's request, the invoice for the purchase of Mayuri products can be sent to you by e-mail to the e-mail address indicated by the customer in PDF format.

 

DELIVERIES

 

For all orders placed on our website, we will inform you in writing at the email address you have provided, of the status of the order.

 

Place of delivery

The products are delivered to the delivery address indicated during the ordering process.

Before confirming the order, please make sure that the delivery address is correct.

Please note that P.O. Boxes are not accepted by MAYURI for deliveries. Remember to fill in as much information as possible so that the deliveryman can correctly honour the delivery: Digicode, apartment number, intercom, floor, etc...

 

Delivery time

Orders will be dispatched the same day (if working day), if your order is registered before 04:00.

Beyond that date, we will ship on the next business day.

From the day of shipment, the products will be delivered to you within 24-48 hours or more depending on the delivery method selected.

  

Mode of delivery

  • Colissimo with signature: Delivery within 48 hours, if you are not at the address you have indicated, either the postman will come back the next day at the same address, or simply leave a notice in your mailbox to pick up your package at the address he has indicated.
  • Chronopost : Delivery in 24 hours from the dispatch email of your order

 

Late delivery

We invite you to regularly check the status of your order on the site (see My Orders) or by calling our customer service.

We shall not be held liable for any delay in delivery in the event of force majeure, weather conditions, strikes or any other conditions beyond our control that prevent the smooth running of the delivery.

We will keep you informed of any shipping delays that we become aware of.

If you order several products at the same time and only some of them are delayed, we can split the shipments.

In this case, we will notify you of the arrangements we intend to make before the delivery is launched.

In the event that the package appears damaged or spoiled, you must refuse it to the carrier and notify us of your refusal.

 

Observations on the delivery or products delivered

It is imperative that you check the packages and products upon delivery.

For a shipment against signature, please check the contents of the package, otherwise we cannot guarantee a refund for damaged products.

 

 

PRODUCT RETURNS

 

You have 30 days from the delivery of the jewels to return a product.

No exchange or replacement is possible, you will have to place a new order online.

For a return, you must imperatively inform the MAYURI customer service by e-mail or telephone of your decision before returning the products to us. It will be necessary to indicate us the reason of return and thus to follow the process of return. Your request for return is effective only from the moment when MAYURI acknowledges receipt of your return request in writing.

The return costs concerning transport and insurance are paid by MAYURI in mainland France, excluding the "Guarantees" frame.

 Return Process :

Please note that it is important to keep everything, even the original cardboard packaging to proceed with the return of the package. All contents in the original packaging must be intact.

The jewelry box, the contents in the jewelry box, i.e. insert, storage insert and the jewelry present at the time of shipment. The same applies to any other case, chamois in its plastic packaging and the cotton pouch.

1. Indicate the reason for the return by e-mail.

2. Once validated by MAYURI, follow the return process indicated.

3. Carefully pack the jewelry in the original box and all the contents you received in the package. 

4. Print the return label, stick the detachable part on the package so that it is legible by the carrier. Also print out the return slip to be inserted into the package.

5. Close the box and drop the package off at your nearest post office.

Upon receipt of the package, we check that the jewel is in perfect condition, then acknowledge receipt of the jewel.

We will then refund the price corresponding to the value of the products no later than 14 days following the date on which the return was accepted by MAYURI.

Thus, items returned incomplete, damaged, deformed, damaged or soiled will not be taken back under any circumstances. In particular, products with scratches, even discreet ones, can never be taken back.

Carrier fees (Chronopost and DHL) are non-refundable.

If you have chosen the wrong size when placing your order, the procedure to follow is the same as for any other return.

Concerning personalized product returns: Article L 121-20-2 of the Consumer Code provides that the right of withdrawal cannot be exercised for contracts for the supply of goods made to the consumer's specifications or clearly personalised. However, we undertake to reimburse you for clearly personalised products that do not correspond to your order (defective or non-compliant).

Please note that any returns sent to our head office address in Paris instead of the address indicated above will be invoiced at €11.50.

Please note that no refunds or exchanges for :

- a gold ring of size less than 47 or more than 58 (Ring made on request)
- an engraved jewel
- a made-to-measure realization

Your request for return is only effective from the moment that Mayuri acknowledges receipt of your return request in writing.


 

WITHDRAWAL PERIOD

 

In accordance with the law, the customer who is not satisfied with his order has 14 days after receipt of the goods to request a refund.

The Customer does not have to provide any particular reason to use his right of withdrawal. 

Please contact MAYURI customer service at the following e-mail address: [email protected], so that they can send you the withdrawal form to complete. Indicate in the subject line: Withdrawal for order NUMBER_DE_COMMANDE.

This form will be to be returned by mail and to be inserted in the return of the parcel.

 

REFUNDS AND CREDIT NOTES

 

At MAYURI, we offer you two possibilities after return and verification of the product and its contents:

  1. A refund within 14 days of receipt of the package (subject to verification of the contents returned by the customer) on the means of payment used at the time of purchase or,
  2. A credit note to be used within 6 months (subject to verification of the contents returned by the customer) from receipt of the return of your package.

 

COMMERCIAL GUARANTEES

 

We guarantee all our silver and vermeil products for 1 year and our 9, 14 and 18-carat gold products for 2 years.

The warranty period starts from the date of delivery of the product.

We do not cover the cost of returns under the guarantee.

To make use of this warranty, please contact MAYURI customer service by e-mail at [email protected], indicating in the subject line of your e-mail: MAYURI WARRANTY -Yourorder number.

In this warranty, we cover jewelry repairs such as clasp replacement, broken chain or stones to be set.

This commercial warranty does not apply in the following cases:

  • Abnormal or improper use or misuse;
  • Deterioration due to a handling error, abusive or abnormal use, intentional or accidental physical modification, use for professional or commercial purposes;
  • In the event of abnormal maintenance or in the event of a lack of maintenance and hygiene;
  • In case of natural wear ;
  • Interventions carried out on the jewellery by any person not mandated by Customer Service as well as any damage resulting from such an intervention.

When the commercial guarantees are not applicable, MAYURI can propose you an estimate for the restoration of the product. Please contact the MAYURI customer service department in order to explain in detail the state of the product and the supposed repairs to be planned. 

The warranty can only be exercised once per product.

 

LEGAL ASSURANCES

 

MAYURI respects the legislation in force concerning the defects of conformity of the product to the Contract and the redhibitory defects under the conditions envisaged in articles 1641 to 1649 of the Civil code:

Article 1641 of the Civil Code: The seller is bound by the guarantee on account of the hidden defects of the thing sold which render it unfit for the use for which it is intended, or which so diminish this use that the buyer would not have acquired it, or would only have given a lower price for it, if he had known about them.

Article 1644 of the Civil Code: In the case of articles 1641 and 1643, the buyer has the choice of returning the item and having the price refunded, or of keeping the item and having part of the price refunded.

Article 1648 paragraph 1 of the Civil Code: The action resulting from redhibitory defects must be brought by the purchaser, within two years from the discovery of the defect". 

Article L. 217-4 of the French Consumer Code: The seller is required to deliver goods in conformity with the contract and is liable for any lack of conformity existing at the time of delivery. It is also liable for defects in conformity resulting from packaging, assembly instructions or installation when the latter has been charged to it by the contract or has been carried out under its responsibility.

Article L. 217-5 of the Consumer Code: To be in conformity with the contract, the goods must :

1° Be fit for the use usually expected of a similar good and, where applicable :

- correspond to the description given by the seller and possess the qualities that the seller has presented to the buyer in the form of a sample or model;

- have the qualities that a buyer may legitimately expect in the light of public statements made by the seller, the producer or his representative, in particular in advertising or labelling ;

2° Or have the characteristics defined by mutual agreement between the parties or be suitable for any special use sought by the buyer, brought to the seller's attention and accepted by the latter.

Article L217-9 of the Consumer
Code In the event of a lack of conformity, the buyer chooses between repairing or replacing the goods.
However, the seller may not proceed according to the buyer's choice if this choice entails a cost that is manifestly disproportionate to the other method, taking into account the value of the good or the importance of the defect. In such a case, the seller is bound to proceed, unless it is impossible, according to the method not chosen by the buyer.

Article L. 217-12 of the Consumer Code: The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.

All the information requested on the mayuri.fr website during an order, or the registration to the newsletter are the following: first name, last name, address, email.

In addition, certain information will be collected when browsing the mayuri.fr via cookies.

This personal information is only used within the framework of the exercise of the mayuri.fr site, in order to guarantee a better follow-up of the orders, an improvement of our services and for purposes of advertising re-targeting. The MAYURI company undertakes not to provide this personal information to any third party without the prior agreement of the Client.

Customers may at any time exercise their right to access, rectify and refuse the processing of their personal data, in accordance with articles 38, 39 and 40 of the French Data Protection Act. To do so, please contact us at the following address: [email protected].

It is also possible to unsubscribe at any time from the newsletter or our mailings.

 

 

RESPONSIBILITIES

 

The MAYURI company cannot be held responsible for events preventing the good realization of the contract and which would be imputable to the customer, to a third party to the contract or to a case of force majeure.

Furthermore, the information contained in the site may contain technical inaccuracies or translation or typographical errors and www. mayuri.fr cannot be held responsible for them. The MAYURI company is not responsible for the use of the other sites to which the customers can reach via links on mayuri.fr. 

If a condition is found to be illegal or invalid, it will not invalidate the other conditions.

 

PROPER LAW

 

Sales concluded with MAYURI via the mayuri.fr website are subject to French law.

In the event of a dispute, an amicable solution will be sought before any legal action is taken. Failing this, all the litigations to which the present contract could give rise, concerning its validity, its interpretation, its execution, its cancellation, their consequences and their consequences will be subjected to the competent court attached to the domiciliation of the MAYURI company in accordance with the rules of competence of the common law.

 

INTELLECTUAL PROPERTY

 The MAYURI company is the owner of the site www. mayuri.fr.

In addition, the graphics, texts and more generally everything that makes up the mayuri.fr site are the property of the MAYURI company or its suppliers.

All other graphics appearing on the jewels and the website www. mayuri.fr belong to the MAYURI company and cannot be reproduced. The photos and the diagrams representing the products cannot be reproduced.

All products, names, logos, brands and titles used on this site are trademarks or registered names of their owners.

It is also reminded that all the drawings, models and plans belong to MAYURI which benefits from an artistic property right on all its products.

The Customer declares that he acknowledges that any counterfeiting, of the brand, the designs or model or other graphics, may be punished by criminal and/or civil sentences at the discretion of MAYURI.
